Until now, users believe that embedding images rather than hosting them directly provides insulation against copyright claims. He further said, the rights applicable in our platform policies require a third party to get the necessary rights from the holders. In this, if a license is required by law, then they have to ensure the license to share this content.
This news has come at a time when a judge in New York said in his decision that Newsweek cannot dismiss a photographer’s complaint based on Instagram’s terms of service. However, Instagram told Ars Technica that it is exploring more ways for users to control embedding. At the moment photographers can strictly limit their access to Instagram and can only prevent embedding by making the photo private.
