Government says only authorized law enforcement agencies can tap telephones

The government on Tuesday said only authorized law enforcement agencies in the country have the right to intercept and monitor telephone taps or any electronically transmitted information. Union Minister of State for Home Ajay Kumar Mishra said this in response to a question whether national or international agencies are authorized to monitor and decrypt any digital information, including WhatsApp conversations.

“Only authorized law enforcement agencies in the country have the right to intercept, monitor or decrypt or intercept or monitor or decrypt any information generated, transmitted, received or stored in any computer resource in accordance with the legal provisions of section 69 of the information. Technology Act, 2000,” he said while answering a written question.

The Minister said that the safeguards and review mechanism for telephone tapping have been laid down in the Information Technology (Process and Security for Interception, Monitoring and Decryption of Information) Rules, 2009 and also in the Standard Operating Procedure issued for the purpose.
