Huawei, ZTE patent appeals dismissed by UK Supreme Court

The United Kingdom’s Supreme Court on Wednesday unanimously rejected the appeals of China’s Huawei and ZTE in patent disputes over mobile data technology with Unwired Planet International and Converse Wireless.

The first appeal pertained to an action brought by Unwired against Huawei for infringement of five UK patents that Unwired had acquired from Ericsson and said to be essential in mobile telecoms.

An English court had previously ruled that the two patents were valid and necessary, and a subsequent trial found that the terms of Unwired’s license were reasonable and enforceable.

The second appeal took action by Converse against Huawei and ZTE for infringing on four of its UK patents, which were obtained from Nokia and related to LTE standards used by 4G handsets to download and send data. was.

Huawei and ZTE argued that English courts do not have jurisdiction to determine the validity of foreign patents.

But the trial judge ruled against him, saying the court has jurisdiction under the international patent framework agreed upon by the mobile industry.

The Supreme Court on Wednesday said it had unanimously dismissed both the appeals.

The Conversation CEO Boris Texler said he was “very pleased” with the results, which the firm said would have “significant worldwide implications” for standards-required-patent (SEP) licensing.

“This reaffirms Convergent Wireless’ view, that as holders of the cellular standards-required patent, we can seek a fair price for our patents without the UK courts granting themselves country-by-country licensing.” ‘Insanity’ related litigation,” he said.
